Welcome to Lovetobid.com. This User Agreement describes the terms and conditions that apply to the buying or bidding of goods or other services being offered. You must register and accept the terms of this Agreement in order to bid. BY REGISTERING, YOU AGREE TO BE BOUND BY THIS AGREEMENT AND ALL POLICIES AND GUIDELINES INCORPORATED BY REFERENCE. Lovetobid.com reserves the right to change or modify any of the terms and conditions contained in this Agreement or any policy or guideline of the site at any time and in its sole discretion. Any changes or modification will be effective upon posting of the revisions on this site. Changes or modifications to referenced policies and guidelines may be posted without notice to you. It is your responsibility to carefully read this Agreement before using this Site or the Services. Your continued use of this Site and the Services following Lovetobid.com posting of its changes or modifications will constitute your acceptance of such changes or modifications. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT OR ANY MODIFICATION, DO NOT REGISTER OR CONTINUE TO USE THE SERVICES OR THIS SITE.
Your bid is a legal offer to buy an item or items being auctioned on lovetobid.com. Once accepted a contract is created between the buyers and seller. By entering into this agreement and bidding, you agree to complete the transaction as described and fulfill any and all contractual obligations.
You must be 18 yrs. or older to register to bid.
All bidders must provide their full name, address and daytime/evening phone number. Lovetobid.com reserves the right to deny registration.
Lovetobid.com reserves the right to refuse access to the site as they deem necessary.
A cash deposit may be required to register or to continue bidding after a certain dollar amount has been reached.
All items in the auction will be sold to the highest bidder unless the seller has a minimum reserve price. In which case the item will not be sold until the reserve price is reached. In some cases, the auctioneer may protect the reserve price for the seller.
There is a designated inspection time for all items being auctioned. Bidders can and should inspect all items prior to bidding. All items are sold AS IS, WHERE IS WITH ALL FAULTS. LovetoBid.com is not liable for providing any purpose of use or value of any item as well as functionality, condition or warranty status of any items being auctioned. Online photographs are added as a convenience for the bidder and should not be interpreted to create representations or warranties for any item. Lovetobid.com relies upon information from the seller concerning the condition of all items and makes no investigation or warranty about the accuracy or completeness of this information.
The bidder is liable for the costs, liability, and hazards of removing all items including disconnecting of utilities. Rights of the high bidder to purchase the item end on the last day and time of announced checkout. At this time the item(s) will be considered abandoned by high bidder. Lovetobid.com reserves the right to dispose of the items according to its discretion. Any high bidder that fails to complete a transaction will be held responsible for all damages resulting from not completing the contract included but not limited to, storage costs, interest, filing fees, and attorney’s fees. Items paid by the high bidder but not removed by the announced checkout will be considered abandoned, and will be disposed of at the discretion of lovetobid.com. A refund will not be given. At the time of removal, the bidders or agents are responsible for checking that all paid/purchased items are in their possession. If there is a discrepancy, it must be resolved within one day of pickup.
No claims will be allowed after an item has been removed from the auction site. Neither Lovetobid.com nor the seller shall be held liable for non-delivery to any high bidder of any item. If payment has been made the high bidder shall receive a refund for the sum paid. This guarantee of refund shall be null and void if high bidder fails to remove item before the last day of announced pickup/removal times. In no event shall Lovetobid.com be liable to any bidder for any act or omission occurring in connection with the auction for an amount that exceeds the amount that such bidder has actually paid to lovetobid.com, as a deposit or as payment for a purchased item.
Items may be sold individually or in multiple quantities. Items may be removed from the auction by the seller with authorization of the seller and Lovetobid.com, before or after auction has concluded. Only compensation to the high bidder will come in the form of a refund of the amount paid, if money has been exchanged.
Bidder agrees to: Conclude the business deal within the parameters of this agreement. Consider each bid placed as a binding contract. Take note that buyers premiums and applicable taxes will be paid in full at time of pickup. Any payments will be forfeited if balance is not paid by specified time.
By participating in an auction, bidders represent, irrefutably warrant and covenant that:
-They shall not misrepresent their ability to close the transaction pursuant to the terms and conditions of the auction. -They have the capacity to close the transaction and that any bid they make on the item constitutes an irrevocable offer to buy the item for the full amount of the bid plus buyer’s premium and applicable taxes
-They have the legal authority to enter into an agreement to purchase the item
-They shall forfeit all deposits or otherwise pay as liquidation damages all monies paid if payment is not made in full by the time specified.
Immediate notification is required if a mistake is made in bidding. Bidders may still be held responsible for the bid.
Potential bidders when inspecting and high bidders/purchasers or their agents acknowledge that an auction site is a potentially dangerous place. Every person enters the auction site at his or her own risk with notice of the condition of the premises and the activities that will be or have been conducted on the premises. High bidders will so advise their agents and employees. This acknowledged risk extends into all activities involved in the removal of items including disconnection of utilities. Persons attending the auction site during preview, sale or removal assume all risks of injury damage or loss of property and specifically release Lovetobid.com and the seller from liability.
Lovetobid.com cannot guarantee that the seller will complete the sale of the item or items, or the buyer will complete the sale or the item or items bought on lovetobid.com. All risk of participating in the auction are assumed by the buyer and seller. You hereby release lovetobid.com and its representative from any disputes, claims, demands or damages of any kind, whether known or unknown arising from or related to the use of lovetobid.com, including but not limited to uncompleted transactions and any claims or disputes between buyers and sellers.
Lovetobid.com will post the removal date and times for auctions online. Lovetobid.com is not responsible for item removal. High bidder and associates take full liability for proper disassembly and disconnection of equipment. Bidders and associates are required to be aware and adhere to government safety and environmental laws. Lovetobid.com is not liable for removing hazardous materials from any items. Responsibility of the buyer or their associates.
The results of the auction may be rendered void if malfunction, shutdown, or temporary loss of service occurs. In such an event, Lovetobid.com reserves the right to remedy the situation in whichever way best represents the seller, including the cancellation of existing bids. Lovetobid.com shall not be held liable in any way for any malfunctions, shutdowns, or loss of service.
Auction listings end at the time stated on the lovetobid.com unless item is being bid on within the last 2 minutes, in which case it will be automatically extended by 3 minutes by every concurring bid.
At the conclusion of the auction, invoices will be emailed to the winning bidders. If you do not receive an invoice within 24hrs. of the conclusion of the auction, please call 952-240-3038. Winning bidders are expected to make arrangement for removal. Applicable taxes and fees will be applied at the end of the sale. All resales must provide a resale or tax exempt certificate at the time of making payment or taxes will be charged. This must be done every time, we do not keep records at pick up of prior resale or tax exempt certificates.
Methods of payment include: Cash, Cashier’s Checks, Money orders and Wire Transfers. Credit or debit cards will be charged a 3% processing fee.
Payment is made by wire transfer the day before pickup or by guaranteed funds at the auction site when picking up.
Purchaser and Bidders agree to indemnify and hold harmless both the seller and Lovetobid.com from and against all claims and liabilities resulting from online auction, including but not limited to: proximate or consequential damages, failure to comply with local, state, or federal laws, and cost of legal expenses arising there from. No person shall have any claim against Lovetobid.com, their respective agents or employees for any injuries sustained or damages to or loss of property that may occur at the auction site.
These Terms and Conditions, and all questions with respect to the interpretation of these conditions, shall be governed by and construed in accordance with the internal laws of the State of Minnesota, without regard to conflict of law’s provisions. All bidders expressly consent to personal and exclusive jurisdiction in the courts of the State of Minnesota located in Hennepin County. In bidding, you consent to agreeing with all the Terms and Conditions stated above and any auction specific terms posted on each auctions event page and/or terms emailed to you and or terms posted on Lovetobid.com.
